1. In Bezug auf Gas und Wärme gilt diese Verordnung für folgende Tätigkeiten:
a) die Bereitstellung oder das Betreiben fester Netze zur Versorgung der Öffentlichkeit im Zusammenhang mit der Erzeugung, der Fortleitung oder der Abgabe von Gas oder Wärme;
b) die Einspeisung von Gas oder Wärme in die unter Buchstabe a genannten Netze.
2. Die Einspeisung von Gas oder Wärme in feste Netze zur Versorgung der Allgemeinheit durch einen Sektorenauftraggeber, bei dem es sich nicht um einen öffentlichen Auftraggeber handelt, gilt nicht als Tätigkeit im Sinne des Absatzes 1, wenn die beiden folgenden Bedingungen erfüllt sind:
a) die Erzeugung von Gas oder Wärme durch diesen Sektorenauftraggeber die unvermeidbare Folge der Ausübung anderer als der in Absatz 1 dieses Artikels oder in den Artikeln 13, 14 oder 15 genannten Tätigkeiten ist;
b) die Einspeisung in das öffentliche Netz nur der wirtschaftlichen Nutzung dieser Erzeugung dient und bei Zugrundelegung des Durchschnitts der letzten drei Jahre vor dem Jahr, in dem die Einspeisung erfolgt, nicht mehr als 20 % des Umsatzes des Sektorenauftraggebers ausmacht.

1. In relation to gas and heat, this Regulation applies to the following activities:
(a) the provision or operation of fixed networks intended to provide a service to the public in connection with the production, transport or distribution of gas or heat;
(b) the supply of gas or heat to the networks referred to in point (a).
2. The supply by a contracting entity other than a contracting authority of gas or heat to fixed networks which provide a service to the public shall not constitute a relevant activity within the meaning of paragraph 1 of this Article where both of the following conditions are met:
(a) the production of gas or heat by that contracting entity is the unavoidable consequence of carrying out activities other than those referred to in paragraph 1 of this Article or in Articles 13, 14 or 15;
(b) the supply to the public network is aimed only at the economic exploitation of such production and amounts to not more than 20 % of the contracting entity's turnover on the basis of the average for the three years preceding the one in which the supply is made.
