1. Toto nařízení se nepoužije, pokud si regionální nebo místní orgány svěří plnění úkolů, které jim byly svěřeny, nebo k tomuto účelu použijí vlastní zdroje druhé strany, a to i pouze za úplatu, za předpokladu, že tento úkol plní z vlastních zdrojů. Pro účely tohoto článku vlastní zdroje nezahrnují zboží, které dosud nebylo pořízeno, ani služby, které jsou poskytovány jednomu ze zúčastněných místních nebo regionálních orgánů hospodářskými subjekty nebo právnickými osobami pověřenými podle čl. 80 odst. 1, 2 a 3.
2. Pro účely tohoto článku zahrnují „regionální orgány“ orgány, jejichž demonstrativní výčet je uveden v NUTS 1 a NUTS 2 podle nařízení (ES) č. 1059/200357, zatímco „místní orgány“ zahrnují všechny orgány správních jednotek spadajících pod NUTS 3 a menších správních jednotek podle uvedeného nařízení.

Local and regional administrative cooperationReplaces: Para. 1 Directive 2014/23/EU · , 2 Para.2 Directive 2014/24/EU
1. This Regulation does not apply where regional or local authorities entrust each other with the performance of tasks incumbent on them, or use each other’s own resources for that purpose, including in exchange for remuneration only, provided that they perform the task by own resources. For the purposes of this Article, own resources do not include goods not yet acquired or services that are being provided to one of the participating local or regional authorities by economic operators or legal persons entrusted pursuant to Article 80(1), (2) and (3).
2. For the purpose of this Article, ‘regional authorities’ includes authorities listed non-exhaustively in NUTS 1 and NUTS 2, as referred to in Regulation (EC) No 1059/200357, while ‘local authorities’ includes all authorities of the administrative units falling under NUTS 3 and smaller administrative units, as referred to in that Regulation.
