Artikel 70
Erfasste Wirtschaftsteilnehmer, Waren, Dienstleistungen oder BauleistungenErsetzt: Abs. 1 Richtlinie 2014/25/EU
1. Ein Wirtschaftsakteur gilt für die Zwecke dieser Verordnung als „erfasst“, wenn er seinen Ursprung gemäß Artikel 74 Absatz 1 hat in
a) einem Drittland, das Vertragspartei des GPA ist, sofern die betreffende Beschaffung unter Berücksichtigung der geltenden Anhänge in den Anwendungsbereich der Verpflichtungen der Union im Rahmen dieses Abkommens fällt;
b) ein Drittland, das ein bilaterales oder multilaterales Handelsabkommen mit der Union geschlossen hat, unter den in diesem Abkommen festgelegten Bedingungen, sofern die betreffende Beschaffung in den Anwendungsbereich der Verpflichtungen der Union im Bereich der Vergabe öffentlicher Aufträge fällt, die in diesem Abkommen festgelegt sind;
c) einem Drittland, das mit der Union ein Abkommen zur Gründung einer Zollunion geschlossen hat, unter den in diesem Abkommen festgelegten Bedingungen, sofern die betreffende Beschaffung in den Anwendungsbereich der Verpflichtungen der Union im Bereich der Vergabe öffentlicher Aufträge fällt, die in diesem Abkommen festgelegt sind.
2. Waren, Dienstleistungen oder Bauleistungen gelten als „erfasst“ im Sinne dieser Verordnung, wenn sie ihren Ursprung gemäß Artikel 74 Absätze 2, 3 und 4 haben in
a) einem Drittland, das Vertragspartei des GPA ist, sofern die betreffende Beschaffung unter Berücksichtigung der geltenden Anhänge in den Anwendungsbereich der Verpflichtungen der Union im Rahmen dieses Abkommens fällt;
b) ein Drittland, das ein bilaterales oder multilaterales Handelsabkommen mit der Union geschlossen hat, unter den in diesem Abkommen festgelegten Bedingungen, sofern die betreffende Beschaffung in den Anwendungsbereich der Verpflichtungen der Union im Bereich der Vergabe öffentlicher Aufträge fällt, die in diesem Abkommen festgelegt sind;
c) einem Drittland, das mit der Union ein Abkommen zur Gründung einer Zollunion geschlossen hat, unter den in diesem Abkommen festgelegten Bedingungen, sofern die betreffende Beschaffung in den Anwendungsbereich der Verpflichtungen der Union im Bereich der Vergabe öffentlicher Aufträge fällt, die in diesem Abkommen festgelegt sind.

Article 70
Covered economic operators, goods, services or worksReplaces: Para. 1 Directive 2014/25/EU
1. An economic operator shall be considered ‘covered’ for the purposes of this Regulation when it has its origin pursuant to Article 74(1) in:
(a) a third country that is party to the GPA, provided that the procurement in question falls within the scope of the Union's commitments under that agreement, taking into account the applicable Annexes;
(b) a third country that has concluded a bilateral or multilateral trade agreement with the Union, under the conditions laid down in that agreement, provided that the procurement in question falls within the scope of the Union’s public procurement commitments in that agreement;
(c) a third country that has concluded with the Union an agreement establishing a customs union, under the conditions laid down in that agreement, provided that the procurement in question falls within the scope of the Union’s public procurement commitments in that agreement.
2. Goods, services or works shall be considered ‘covered’ for the purposes of this Regulation when they have their origin pursuant to Article 74(2), (3) and (4) in:
(a) a third country that is party to the GPA, provided that the procurement in question falls within the scope of the Union's commitments under that agreement, taking into account the applicable Annexes;
(b) a third country that has concluded a bilateral or multilateral trade agreement with the Union, under the conditions laid down in that agreement, provided that the procurement in question falls within the scope of the Union’s public procurement commitments in that agreement;
(c) a third country that has concluded with the Union an agreement establishing a customs union, under the conditions laid down in that agreement, provided that the procurement in question falls within the scope of the Union’s public procurement commitments in that agreement.
