Artikel 74
HerkunftErsetzt: Abs. 2 Richtlinie 2014/25/EU
1. Die Herkunft der Wirtschaftsteilnehmer oder Unterauftragnehmer wird gemäß Artikel 3 Absatz 1 der Verordnung (EU) 2022/1031 55 bestimmt.
2. Der Ursprung von Waren wird gemäß Titel II Kapitel 2 Abschnitt 1 der Verordnung (EU) Nr. 952/2013 56 bestimmt.
3. Die Herkunft der Dienstleistungen bestimmt sich nach der Herkunft des Wirtschaftsteilnehmers oder Unterauftragnehmers, der die Dienstleistung erbringt.
4. Die Gesamtherkunft der Bauleistungen bestimmt sich nach der Herkunft des Wirtschaftsteilnehmers oder Unterauftragnehmers, der sie erbringt. Für die Erfordernisse der europäischen Präferenz können die Käufer den Ursprung der Waren, die als Teil der Werke gemäß Absatz 2 verwendet werden, gesondert bestimmen.

Article 74

1. The origin of economic operators or subcontractors shall be determined in accordance with Article 3(1) of Regulation (EU) 2022/103155.
2. The origin of goods shall be determined in accordance with Title II, Chapter 2, Section 1 of Regulation (EU) No 952/201356.
3. The origin of services shall be determined on the basis of the origin of the economic operator or subcontractor providing the service.
4. The overall origin of works shall be determined pursuant to the origin of the economic operator, or subcontractor, providing it. For the European preference requirements, buyers may determine separately the origin of the goods used as part of the works pursuant to paragraph 2.
