Monitorowanie funkcjonowania rynków zamówień publicznychZastępuje: dyrektywy 2014/23/EU · dyrektywy 2014/24/EU · ust. 2 dyrektywy 2014/25/EU
1. Państwa członkowskie monitorują i oceniają funkcjonowanie swoich systemów zamówień publicznych na podstawie danych zawartych w ich NPPDS. Strony identyfikują potencjalne niedociągnięcia i możliwe usprawnienia, wspierając tym samym ciągłe doskonalenie swojego systemu zamówień publicznych.
Państwa członkowskie co najmniej:
a) ocenia bariery dla konkurencji i dostępu do możliwości w zakresie zamówień publicznych, w szczególności dla MŚP;
b) identyfikuje i ocenia główne słabe punkty i zagrożenia wpływające na integralność i efektywność systemu zamówień publicznych;
c) ocenia stosowanie mechanizmów bezpieczeństwa, odporności i preferencji europejskiej, w tym identyfikuje wszelkie oznaki obchodzenia przepisów przez wykonawcy w odniesieniu do tych ostatnich;
d) ocenia postępy w osiąganiu strategicznych celów w zakresie zamówień publicznych, z uwzględnieniem aspektów środowiskowych, społecznych i związanych z innowacjami;
monitorowanie wyników, dostosowań i modyfikacji dużych projektów infrastrukturalnych i umów długoterminowych, takich jak koncesje.
Wyniki oceny, o której mowa w akapicie drugim, są podawane do wiadomości publicznej za pomocą odpowiednich środków informacji co najmniej raz w roku.
W przypadku stwierdzenia niedociągnięć strukturalnych środki służące ich wyeliminowaniu są wspierane przez państwa członkowskie, które opracowują i wdrażają kompleksowy plan działania dla poszczególnych krajów.
2. Co trzy lata państwa członkowskie składają Komisji sprawozdanie na temat wyników oceny oraz, w przypadku stwierdzenia niedociągnięć strukturalnych, na temat środków podjętych, planowanych lub planowanych w celu zaradzenia tym niedociągnięciom, przy czym pierwsze sprawozdanie należy złożyć do dnia... 3. Komisja monitoruje i analizuje funkcjonowanie zamówień publicznych w Unii, w szczególności konkurencję na rynkach zamówień publicznych, na podstawie danych z przestrzeni danych dotyczących zamówień publicznych. Co trzy lata Komisja przedstawia analizę systemu zamówień publicznych w całej Unii.

Monitoring of the performance of public procurement marketsReplaces: Directive 2014/23/EU · Directive 2014/24/EU · Para. 2 Directive 2014/25/EU
1. Member States shall monitor and assess the performance of their public procurement systems, on the basis of the data in their NPPDS. They shall identify potential shortcomings and possible improvements, thereby supporting the continuous enhancement of their public procurement system.
Member States shall as a minimum:
(a) assess the barriers to competition and access to procurement opportunities, in particular for SMEs;
(b) identify and assess the main vulnerabilities and risks affecting the integrity and efficiency of the public procurement system;
(c) assess the application of security, resilience and European preference mechanisms, including identifying any indications of circumvention by economic operators for the latter;
(d) evaluate progress in achieving the strategic procurement objectives, including environmental, social and innovation considerations;
(e) monitor the performance, adjustments and modifications of large infrastructure projects and long-running contracts such as concessions.
The results of the assessment referred to in the second subparagraph shall be made publicly available through appropriate means of information, at least once a year.
Where structural shortcomings have been identified, the measures to address them shall be underpinned by Member States developing and implementing a comprehensive, country-specific action plan.
2. Every three years, Member States shall report to the Commission on the results of the assessment and, where the structural shortcomings are identified, on the measures taken, planned or envisaged to address those shortcomings, with the first report due by … [OP please insert the date three years after the entry into force of this Regulation].
3. The Commission shall monitor and analyse the functioning of public procurement in the Union, in particular the competition in procurement markets, on the basis of the data in the Public Procurement Data Space. The Commission shall every three years provide an analysis of the public procurement system across the Union.
