ANLAGE III
Verzeichnis der Verfahren und Rechtsakte der Union nach Artikel 8 Absatz 3 und Artikel 117 Absatz 1
Die folgenden Verfahren, die eine angemessene vorherige Transparenz gewährleisten, gelten für die Erteilung von Genehmigungen gemäß anderen Rechtsakten der Union, die keine „besonderen oder ausschließlichen Rechte“ im Sinne der Artikel 8 und 117 dieser Verordnung darstellen:
a) Erteilung einer Genehmigung zum Betrieb von Erdgasanlagen nach den Verfahren des Artikels 8 der Richtlinie (EU) 2024/1788 des Europäischen Parlaments und des Rates1;
b) Genehmigung oder Ausschreibung für den Bau neuer Stromerzeugungsanlagen gemäß der Richtlinie (EU) 2019/944 des Europäischen Parlaments und des Rates2;
c) die Erteilung von Genehmigungen für Postdienste nach den Verfahren des Artikels 9 der Richtlinie 97/67/EG;
d) ein Verfahren zur Erteilung einer Genehmigung für die Ausübung einer Tätigkeit der Gewinnung von Kohlenwasserstoffen gemäß der Richtlinie 94/22/EG des Europäischen Parlaments und des Rates3;
e) die Vergabe eines öffentlichen Dienstleistungsauftrags im Sinne der Verordnung (EG) Nr. 1370/2007 für die Erbringung öffentlicher Personenverkehrsdienste mit Bussen, Straßenbahnen, Eisenbahnen oder U-Bahnen, der im Wege eines wettbewerblichen Vergabeverfahrens gemäß Artikel 5 Absatz 3 der genannten Verordnung vergeben wurde, sofern die Laufzeit des Auftrags mit Artikel 4 Absatz 3 oder Artikel 4 Absatz 4 der genannten Verordnung im Einklang steht4.

ANNEX III
List of procedures and Union legal acts referred to in Article 8(3) and 117(1)
The following procedures, which ensure adequate prior transparency, apply to the granting of authorisations pursuant to other legal acts of the Union which do not constitute ‘special or exclusive rights’ within the meaning of Article 8 and 117 of this Regulation:
(a) granting an authorisation to operate natural gas installations in accordance with the procedures laid down in Article 8 of Directive (EU) 2024/1788 of the European Parliament and of the Council1;
(b) authorisation or an invitation to tender for the construction of new electricity production installations in accordance with Directive (EU) 2019/944 of the European Parliament and of the Council2;
(c) the granting in accordance with the procedures laid down in Article 9 of Directive 97/67/EC of authorisations in relation to a postal service;
(d) a procedure for granting an authorisation to carry on an activity involving the exploitation of hydrocarbons in accordance with Directive 94/22/EC of the European Parliament and of the Council3;
(e) the granting of a public service contract within the meaning of Regulation (EC) No 1370/2007 for the provision of public passenger transport services by bus, tramway, rail or metro, which have been awarded on the basis of a competitive tendering procedure in accordance with Article 5(3) thereof, provided that the duration of the contract is in conformity with Article 4(3) or Article 4(4) of that Regulation4.
