ZAŁĄCZNIK III
Wykaz procedur i aktów prawnych Unii, o których mowa w art. 8 ust. 3 i art. 117 ust. 1
Następujące procedury, które zapewniają odpowiednią uprzednią przejrzystość, mają zastosowanie do udzielania zezwoleń na podstawie innych aktów prawnych Unii, które nie stanowią „praw specjalnych lub wyłącznych” w rozumieniu art. 8 i 117 niniejszego rozporządzenia:
a) udzielanie zezwoleń na eksploatację instalacji gazu ziemnego zgodnie z procedurami określonymi w art. 8 dyrektywy Parlamentu Europejskiego i Rady (UE) 2024/17881;
b) zezwolenie lub zaproszenie do składania ofert na budowę nowych instalacji wytwarzania energii elektrycznej zgodnie z dyrektywą Parlamentu Europejskiego i Rady (UE) 2019/9442;
c) udzielanie zezwoleń w odniesieniu do usług pocztowych zgodnie z procedurami określonymi w art. 9 dyrektywy 97/67/WE;
d) procedurę udzielania zezwolenia na prowadzenie działalności polegającej na wydobywaniu węglowodorów zgodnie z dyrektywą 94/22/WE Parlamentu Europejskiego i Rady3;
e) udzielenia zamówienia prowadzącego do zawarcia umowy o świadczenie usług publicznych w rozumieniu rozporządzenia (WE) nr 1370/2007 w zakresie autobusowego, tramwajowego, kolejowego lub metra, udzielonego na podstawie konkurencyjnej procedury przetargowej zgodnie z art. 5 ust. 3 tego rozporządzenia, pod warunkiem że okres obowiązywania umowy jest zgodny z art. 4 ust. 3 lub art. 4 ust. 4 tego rozporządzenia4.

Rozporządzenie (WE) nr 1370/2007 Parlamentu Europejskiego i Rady z dnia 23 października 2007 r. dotyczące usług publicznych w zakresie kolejowego i drogowego transportu pasażerskiego oraz uchylające rozporządzenia Rady (EWG) nr 1191/69 i (EWG) nr 1107/70 (Dz.U. ANNEX III
List of procedures and Union legal acts referred to in Article 8(3) and 117(1)
The following procedures, which ensure adequate prior transparency, apply to the granting of authorisations pursuant to other legal acts of the Union which do not constitute ‘special or exclusive rights’ within the meaning of Article 8 and 117 of this Regulation:
(a) granting an authorisation to operate natural gas installations in accordance with the procedures laid down in Article 8 of Directive (EU) 2024/1788 of the European Parliament and of the Council1;
(b) authorisation or an invitation to tender for the construction of new electricity production installations in accordance with Directive (EU) 2019/944 of the European Parliament and of the Council2;
(c) the granting in accordance with the procedures laid down in Article 9 of Directive 97/67/EC of authorisations in relation to a postal service;
(d) a procedure for granting an authorisation to carry on an activity involving the exploitation of hydrocarbons in accordance with Directive 94/22/EC of the European Parliament and of the Council3;
(e) the granting of a public service contract within the meaning of Regulation (EC) No 1370/2007 for the provision of public passenger transport services by bus, tramway, rail or metro, which have been awarded on the basis of a competitive tendering procedure in accordance with Article 5(3) thereof, provided that the duration of the contract is in conformity with Article 4(3) or Article 4(4) of that Regulation4.
