Seznam postupů a právních aktů Unie uvedených v čl. 8 odst. 3 a čl. 117 odst. 1
Na udělování povolení podle jiných právních aktů Unie, která nepředstavují „zvláštní nebo výhradní práva“ ve smyslu článků 8 a 117 tohoto nařízení, se vztahují tyto postupy, které zajišťují odpovídající předchozí transparentnost:
a) udělení povolení k provozu zařízení pro zemní plyn v souladu s postupy stanovenými v článku 8 směrnice Evropského parlamentu a Rady (EU) 2024/17881;
b) povolení nebo výzva k podávání nabídek na výstavbu nových zařízení na výrobu elektřiny v souladu se směrnicí Evropského parlamentu a Rady (EU) 2019/9442;
c) udělování oprávnění v souvislosti s poštovními službami v souladu s postupy stanovenými v článku 9 směrnice 97/67/ES;
d) postup pro udělování povolení k výkonu činnosti zahrnující těžbu uhlovodíků v souladu se směrnicí Evropského parlamentu a Rady 94/22/ES3;
e) uzavření smlouvy o veřejných službách ve smyslu nařízení (ES) č. 1370/2007 v oblasti poskytování veřejných služeb v přepravě cestujících autobusem, tramvají, železnicí nebo metrem, která byla uzavřena na základě nabídkového řízení v souladu s čl. 5 odst. 3 uvedeného nařízení, za předpokladu, že doba trvání smlouvy je v souladu s čl. 4 odst. 3 nebo čl. 4 odst. 4 uvedeného nařízení4.

ANNEX III
List of procedures and Union legal acts referred to in Article 8(3) and 117(1)
The following procedures, which ensure adequate prior transparency, apply to the granting of authorisations pursuant to other legal acts of the Union which do not constitute ‘special or exclusive rights’ within the meaning of Article 8 and 117 of this Regulation:
(a) granting an authorisation to operate natural gas installations in accordance with the procedures laid down in Article 8 of Directive (EU) 2024/1788 of the European Parliament and of the Council1;
(b) authorisation or an invitation to tender for the construction of new electricity production installations in accordance with Directive (EU) 2019/944 of the European Parliament and of the Council2;
(c) the granting in accordance with the procedures laid down in Article 9 of Directive 97/67/EC of authorisations in relation to a postal service;
(d) a procedure for granting an authorisation to carry on an activity involving the exploitation of hydrocarbons in accordance with Directive 94/22/EC of the European Parliament and of the Council3;
(e) the granting of a public service contract within the meaning of Regulation (EC) No 1370/2007 for the provision of public passenger transport services by bus, tramway, rail or metro, which have been awarded on the basis of a competitive tendering procedure in accordance with Article 5(3) thereof, provided that the duration of the contract is in conformity with Article 4(3) or Article 4(4) of that Regulation4.
