Artikel 127
Elektronische KommunikationNeue Regelung ohne Vorgänger in den geltenden Richtlinien.
1. Auftraggeber verwenden bei ihrem gesamten Austausch mit dem Wirtschaftsteilnehmer im Vergabeverfahren elektronische Kommunikationsmittel. Sie verwenden nur allgemein verfügbare und nichtdiskriminierende Instrumente und ihre Kommunikation erfolgt im Einklang mit der harmonisierten Norm für Einzelheiten der Auftragsvergabe gemäß Artikel 129 Absatz 1 Buchstabe b.
2. Ungeachtet des Absatzes 1 können Auftraggeber andere Kommunikationsmittel nutzen, soweit die elektronische Kommunikation aufgrund der spezifischen technischen Anforderungen des Vergabeverfahrens nicht möglich ist oder soweit dies aus einem der folgenden Gründe erforderlich ist:
a) eine Verletzung der Sicherheit der elektronischen Kommunikation; oder
b) den Schutz der besonderen Sensibilität von Daten, die ein derart hohes Schutzniveau erfordern, dass sie durch den Einsatz elektronischer Kommunikationsmittel nicht angemessen gewährleistet werden können.
3. Bei der gesamten Kommunikation, dem Austausch und der Speicherung von Daten stellen die Auftraggeber sicher, dass die Integrität der Daten und die Vertraulichkeit der Interessenbekundungen, Angebote und Vorschläge für innovative Lösungen gewahrt bleiben und dass sie in der Lage sind, Daten mit dem Wirtschaftsteilnehmer über das Interoperabilitätsnetz gemäß Artikel
128. Sie prüfen den Inhalt der Interessenbekundungen, Angebote und Vorschläge für innovative Lösungen erst nach Ablauf der Frist für deren Einreichung und stellen sicher, dass jeder unbefugte Zugriff erkennbar ist.
4. Ungeachtet des Absatzes 1 des vorliegenden Artikels und des Artikels 65 können Auftraggeber die Verwendung elektronischer Kommunikationsmittel, die nicht allgemein verfügbar und diskriminierungsfrei sind, nur verlangen, wenn dies für die Durchführung des Vergabeverfahrens erforderlich ist und wenn sie allen Wirtschaftsteilnehmern, die an dem Vergabeverfahren teilnehmen wollen, freien und gleichberechtigten Zugang zu diesen Instrumenten gewähren.
5. Im Einklang mit den Artikeln 27 und 37 der Verordnung (EU) Nr. 910/201469 können Auftraggeber die Verwendung fortgeschrittener elektronischer Signaturen oder Siegel, fortgeschrittener elektronischer Signaturen oder Siegel, die auf einem qualifizierten Zertifikat oder qualifizierten elektronischen Signaturen oder Siegeln beruhen, für die Signatur elektronischer Kommunikation durch den Wirtschaftsteilnehmer verlangen.

Electronic communication and interoperability
Article 127
Electronic communicationNew provision, with no predecessor in the current directives.
1. Public buyers shall use electronic communication tools in all their exchanges with the economic operator in the procurement procedure. They shall use only generally available and non-discriminatory tools, and their communication shall be in conformity with the harmonised standard for procurement detail pursuant to Article 129(1) point (b).
2. Notwithstanding paragraph 1, public buyers may use other means of communication to the extent that electronic communication is not possible due to the specific technical requirements of the procurement procedure or to the extent that this is necessary for one of the following reasons:
(a) a breach of security of the electronic communication; or
(b) the protection of the particularly sensitive nature of data requiring such a high level of protection that it cannot be properly ensured by using electronic communication tools.
3. In all communication, exchange and storage of data, public buyers shall ensure that the integrity of data and the confidentiality of expressions of interest, tenders and innovative solution proposals are preserved and that they are able to exchange data with the economic operator through the interoperability network pursuant to Article
128. They shall examine the content of expressions of interest, tenders and innovative solution proposals only after the time limit set for submitting them has expired and shall ensure that any unauthorised access is detectable.
4. Notwithstanding paragraph 1 of this Article and Article 65, public buyers may require the use of electronic communication tools which are not generally available and non-discriminatory only where this is necessary for the conduct of the procurement procedure and where they provide free and equal access to such tools to all economic operators intending to participate in the procurement procedure.
5. In accordance with Articles 27 and 37 of Regulation (EU) 910/201469, public buyers may require the use of advanced electronic signatures or seals, advanced electronic signatures or seals based on a qualified certificate or qualified electronic signatures or seals for the signature of electronic communication by the economic operator.
