Wspólne specyfikacjeNowa regulacja, brak odpowiednika w obecnych dyrektywach.
1. Komisja może przyjmować akty wykonawcze ustanawiające wspólne specyfikacje, o których mowa w art. 88 ust. 4 lit. a), obejmujące zasadnicze wymogi dotyczące semantycznego modelu danych podstawowych elementów postępowań o udzielenie zamówienia, o których mowa w art. 129 ust. 1 lit. a).
Te akty wykonawcze mogą zostać przyjęte, jeżeli Komisja zwróci się, zgodnie z art. 10 ust. 1 rozporządzenia (UE) nr 1025/2012, do co najmniej jednej europejskiej organizacji normalizacyjnej z wnioskiem o opracowanie lub przegląd norm europejskich w odniesieniu do tych wymogów oraz:
a) wniosek nie został przyjęty przez żadną z europejskich organizacji normalizacyjnych, do których został skierowany; lub
b) wniosek został zaakceptowany przez co najmniej jedną z europejskich organizacji normalizacyjnych, do których był skierowany, ale normy europejskie, których dotyczył wniosek:
i) nie zostały dostarczone w terminie określonym we wniosku;
ii) nie stosują się do wniosku; lub
iii) nie spełniają wymagań, które mają obejmować.
2. W przypadku opublikowania odniesień do normy zharmonizowanej w Dzienniku Urzędowym Unii Europejskiej Komisja uchyla akty wykonawcze przyjęte na podstawie ust. 1 lub ich odpowiednie części w zakresie, w jakim obejmują one te same wymogi.
3. Jeżeli państwo członkowskie lub Parlament Europejski uzna, że wspólna specyfikacja lub jej części nie spełniają całkowicie wymagań, które obejmuje, informuje o tym Komisję, przedstawiając szczegółowe wyjaśnienie. Komisja ocenia to szczegółowe wyjaśnienie i w stosownych przypadkach może zmienić akt wykonawczy ustanawiający daną wspólną specyfikację.
Article 130
Common specificationsNew provision, with no predecessor in the current directives.
1. The Commission may adopt implementing acts establishing common specifications as referred to in Article 88(4), point (a), covering the essential requirements for the semantic data model of the core elements of the procurement procedures referred to in Article 129(1), point (a).
Those implementing acts may be adopted where the Commission has requested, pursuant to Article 10(1) of Regulation (EU) No 1025/2012, one or more European standardisation organisations to draft or to revise European standards for those requirements and:
(a) the request has not been accepted by any of the European standardisation organisations to which the request was addressed; or
(b) the request has been accepted by at least one of the European standardisation organisations to which the request was addressed, but the European standards requested:
(i) are not delivered within the deadline set in the request;
(ii) do not comply with the request; or
(iii) do not satisfy the requirements they aim to cover.
2. Where the references of a harmonised standard are published in the Official Journal of the European Union, the Commission shall repeal the implementing acts adopted pursuant to paragraph 1, or the relevant parts thereof, to the extent they cover the same requirements.
3. When a Member State or the European Parliament considers that a common specification or parts thereof do not entirely satisfy the requirements which it covers, it shall inform the Commission thereof by submitting a detailed explanation. The Commission shall assess that detailed explanation and may, if appropriate, amend the implementing act establishing the common specification in question.
