Spoločné špecifikácieNová úprava, v doterajších smerniciach nemá predchodcu.
1. Komisia môže prijať vykonávacie akty, ktorými sa stanovia spoločné špecifikácie uvedené v článku 88 ods. 4 písm. a), ktoré sa vzťahujú na základné požiadavky na sémantický dátový model základných prvkov postupov obstarávania uvedených v článku 129 ods. 1 písm. a).
Uvedené vykonávacie akty sa môžu prijať, ak Komisia podľa článku 10 ods. 1 nariadenia (EÚ) č. 1025/2012 požiadala jednu alebo viaceré európske normalizačné organizácie o vypracovanie alebo revíziu európskych noriem pre tieto požiadavky a:
a) žiadosť neprijala žiadna z európskych normalizačných organizácií, ktorým bola adresovaná; alebo
b) žiadosť prijala aspoň jedna z európskych normalizačných organizácií, ktorým bola adresovaná, ale v európskych normách sa požadovalo:
i) neboli doručené v lehote stanovenej v žiadosti;
ii) nevyhovie žiadosti; alebo
iii) nespĺňajú požiadavky, na ktoré sa majú vzťahovať.
2. Ak sa odkazy na harmonizovanú normu uverejnia v Úradnom vestníku Európskej únie, Komisia zruší vykonávacie akty prijaté podľa odseku 1 alebo ich príslušné časti v rozsahu, v akom sa vzťahujú na rovnaké požiadavky.
3. Ak sa členský štát alebo Európsky parlament domnieva, že spoločná špecifikácia alebo jej časti úplne nespĺňajú požiadavky, na ktoré sa vzťahuje, informuje o tom Komisiu, ktorej poskytne podrobné vysvetlenie. Komisia toto podrobné vysvetlenie posúdi a vo vhodných prípadoch môže zmeniť vykonávací akt, ktorým sa stanovuje dotknutá spoločná špecifikácia.
Article 130
Common specificationsNew provision, with no predecessor in the current directives.
1. The Commission may adopt implementing acts establishing common specifications as referred to in Article 88(4), point (a), covering the essential requirements for the semantic data model of the core elements of the procurement procedures referred to in Article 129(1), point (a).
Those implementing acts may be adopted where the Commission has requested, pursuant to Article 10(1) of Regulation (EU) No 1025/2012, one or more European standardisation organisations to draft or to revise European standards for those requirements and:
(a) the request has not been accepted by any of the European standardisation organisations to which the request was addressed; or
(b) the request has been accepted by at least one of the European standardisation organisations to which the request was addressed, but the European standards requested:
(i) are not delivered within the deadline set in the request;
(ii) do not comply with the request; or
(iii) do not satisfy the requirements they aim to cover.
2. Where the references of a harmonised standard are published in the Official Journal of the European Union, the Commission shall repeal the implementing acts adopted pursuant to paragraph 1, or the relevant parts thereof, to the extent they cover the same requirements.
3. When a Member State or the European Parliament considers that a common specification or parts thereof do not entirely satisfy the requirements which it covers, it shall inform the Commission thereof by submitting a detailed explanation. The Commission shall assess that detailed explanation and may, if appropriate, amend the implementing act establishing the common specification in question.
