AUSNAHMEN FÜR BESTIMMTE TÄTIGKEITEN IM VERSORGUNGSBEREICH
Artikel 19
Unmittelbar dem Wettbewerb ausgesetzte TätigkeitenErsetzt: Richtlinie 2014/23/EU · Richtlinie 2014/25/EU
1. Diese Verordnung gilt nicht für Aufträge zur Ausübung der in den Artikeln 12 bis 18 aufgeführten Tätigkeiten in Bezug auf ein bestimmtes geografisches Gebiet, wenn die Tätigkeit auf Märkten mit freiem Zugang in diesem geografischen Gebiet unmittelbar dem Wettbewerb ausgesetzt ist, sofern dies in einem gemäß Artikel 20 Absatz 4 erlassenen Durchführungsrechtsakt festgelegt wird.
2. Für die Zwecke des Absatzes 1 wird die Frage, ob eine Tätigkeit unmittelbar dem Wettbewerb ausgesetzt ist, anhand von Kriterien entschieden, die mit den Wettbewerbsbestimmungen des Vertrags im Einklang stehen, unbeschadet der Anwendung des Wettbewerbsrechts auf die von der Entscheidung betroffene Situation. Diese Kriterien können Folgendes umfassen:
a) die Merkmale der betreffenden Waren oder Dienstleistungen;
b) das Vorhandensein alternativer Produkte oder Dienstleistungen, die auf der Angebots- oder der Nachfrageseite als substituierbar angesehen werden;
c) die Preise; und
d) die tatsächliche oder potenzielle Präsenz von mehr als einem Anbieter der betreffenden Produkte oder Dienstleistungen auf dem relevanten Markt.
Die betreffende Tätigkeit kann Teil eines größeren Sektors sein oder nur in bestimmten Teilen des Gebiets der Union, einschließlich bestimmter Teile der Mitgliedstaaten, ausgeübt werden.
3. Das geografische Gebiet, auf dessen Grundlage beurteilt wird, ob eine Tätigkeit unmittelbar dem Wettbewerb ausgesetzt ist, besteht aus einem Gebiet, in dem die beteiligten Unternehmen Waren oder Dienstleistungen anbieten und nachfragen, in dem die Wettbewerbsbedingungen hinreichend homogen sind und das sich von benachbarten Gebieten insbesondere durch spürbar unterschiedliche Wettbewerbsbedingungen unterscheidet. Bei dieser Bewertung werden in erster Linie erhebliche Unterschiede bei den Marktanteilen der Unternehmen und das Vorhandensein von Marktzutrittsschranken oder Verbraucherpräferenzen berücksichtigt. Dabei werden auch Faktoren wie die Art und die Merkmale der betreffenden Erzeugnisse oder Dienstleistungen sowie etwaige erhebliche Preisunterschiede zwischen dem betreffenden Gebiet und benachbarten Gebieten berücksichtigt. Der räumliche Geltungsbereich des Gebiets, anhand dessen beurteilt wird, ob eine Tätigkeit dem Wettbewerb ausgesetzt ist, ist auf das Hoheitsgebiet des Mitgliedstaats beschränkt.
4. Für die Zwecke des Absatzes 1 gilt der Zugang zu einem Markt als nicht beschränkt, wenn der Mitgliedstaat die in Anhang IV aufgeführten Rechtsakte der Union umgesetzt hat und anwendet. Andernfalls wird festgestellt, dass der Zugang zu dem betreffenden Markt rechtlich und tatsächlich frei ist.

EXEMPTING PARTICULAR UTILITY ACTIVITIES

Activities directly exposed to competitionReplaces: Directive 2014/23/EU · Directive 2014/25/EU
1. This Regulation does not apply to contracts for the pursuit of activities listed in Articles 12 to 18, with regard to a given geographical area if the activity is directly exposed to competition on markets to which access is not restricted in that geographical area, where that is established by an implementing act adopted pursuant to Article 20(4).
2. For the purposes of paragraph 1, the question of whether an activity is directly exposed to competition shall be decided on the basis of criteria that are in conformity with the provisions on competition of the Treaty, and without prejudice to the application of competition law to the situation subject to the decision. Those criteria may include the following:
(a) the characteristics of the products or services concerned;
(b) the existence of alternative products or services considered to be substitutable on the supply side or demand side;
(c) the prices; and
(d) the actual or potential presence of more than one supplier of the products or provider of the services in question on the relevant market.
The activity concerned may form part of a larger sector or be exercised only in certain parts of the territory of the Union, including certain parts of Member States.
3. The geographical area on the basis of which direct exposure to competition is assessed shall consist of an area in which the undertakings concerned are involved in the supply of and demand for products or services, in which the conditions of competition are sufficiently homogeneous and which can be distinguished from neighbouring areas because, in particular, the conditions of competition are appreciably different in those areas. That assessment shall primarily take into account appreciable differences in the undertakings’ market shares and the existence of market entry barriers or consumer preferences. It shall also take into account factors such as the nature and characteristics of the products or services concerned and any substantial price differences between the area concerned and neighbouring areas. The territorial scope of the area on the basis of which exposure to competition is assessed shall be limited to the territory of the Member State.
4. For the purposes of paragraph 1, access to a market is deemed not to be restricted if the Member State has implemented and applied the Union legal acts listed in Annex IV. Otherwise, it shall be established that access to the market in question is free in law and in fact.
