Rodzaje działalności bezpośrednio podlegające konkurencjiZastępuje: dyrektywy 2014/23/EU · dyrektywy 2014/25/EU
1. Niniejsze rozporządzenie nie ma zastosowania do zamówień na prowadzenie rodzajów działalności wymienionych w art. 12–18 w odniesieniu do danego obszaru geograficznego, jeżeli dana działalność bezpośrednio podlega konkurencji na rynkach, do których dostęp nie jest ograniczony na tym obszarze geograficznym, w przypadku gdy jest to ustanowione w akcie wykonawczym przyjętym na podstawie art. 20 ust. 4.
2. Do celów ust. 1 kwestię, czy dana działalność bezpośrednio podlega konkurencji, rozstrzyga się na podstawie kryteriów zgodnych z postanowieniami Traktatu dotyczącymi konkurencji i bez uszczerbku dla stosowania prawa konkurencji do sytuacji będącej przedmiotem decyzji. Wspomniane kryteria mogą obejmować:
a) cechy danych produktów lub usług;
b) istnienie alternatywnych produktów lub usług uznawanych za zastępowalne po stronie podaży lub popytu;
c) ceny; oraz
faktyczna lub potencjalna obecność na rynku właściwym więcej niż jednego dostawcy danych produktów lub usług.
Dana działalność może stanowić część większego sektora lub być prowadzona wyłącznie w niektórych częściach terytorium Unii, w tym w niektórych częściach państw członkowskich.
3. Obszar geograficzny, na podstawie którego ocenia się bezpośrednie podleganie konkurencji, obejmuje obszar, na którym zainteresowane przedsiębiorstwa uczestniczą w podaży i popycie na produkty lub usługi, na którym warunki konkurencji są wystarczająco jednolite i który można odróżnić od obszarów sąsiadujących, w szczególności ze względu na to, że warunki konkurencji na tych obszarach znacznie się różnią. W ocenie tej uwzględnia się przede wszystkim znaczne różnice w udziałach przedsiębiorstw w rynku oraz istnienie barier wejścia na rynek lub preferencji konsumentów. Uwzględnia ona również takie czynniki, jak charakter i cechy danych produktów lub usług oraz wszelkie istotne różnice cen między danym obszarem a obszarami sąsiednimi. Zasięg terytorialny obszaru, na podstawie którego ocenia się podleganie konkurencji, jest ograniczony do terytorium państwa członkowskiego.
4. Do celów ust. 1 dostęp do rynku uznaje się za nieograniczony, jeżeli państwo członkowskie wdrożyło i stosuje akty prawne Unii wymienione w załączniku IV. W przeciwnym razie zostanie ustalone, że dostęp do danego rynku jest swobodny pod względem prawnym i faktycznym.

EXEMPTING PARTICULAR UTILITY ACTIVITIES
Article 19
Activities directly exposed to competitionReplaces: Directive 2014/23/EU · Directive 2014/25/EU
1. This Regulation does not apply to contracts for the pursuit of activities listed in Articles 12 to 18, with regard to a given geographical area if the activity is directly exposed to competition on markets to which access is not restricted in that geographical area, where that is established by an implementing act adopted pursuant to Article 20(4).
2. For the purposes of paragraph 1, the question of whether an activity is directly exposed to competition shall be decided on the basis of criteria that are in conformity with the provisions on competition of the Treaty, and without prejudice to the application of competition law to the situation subject to the decision. Those criteria may include the following:
(a) the characteristics of the products or services concerned;
(b) the existence of alternative products or services considered to be substitutable on the supply side or demand side;
(c) the prices; and
(d) the actual or potential presence of more than one supplier of the products or provider of the services in question on the relevant market.
The activity concerned may form part of a larger sector or be exercised only in certain parts of the territory of the Union, including certain parts of Member States.
3. The geographical area on the basis of which direct exposure to competition is assessed shall consist of an area in which the undertakings concerned are involved in the supply of and demand for products or services, in which the conditions of competition are sufficiently homogeneous and which can be distinguished from neighbouring areas because, in particular, the conditions of competition are appreciably different in those areas. That assessment shall primarily take into account appreciable differences in the undertakings’ market shares and the existence of market entry barriers or consumer preferences. It shall also take into account factors such as the nature and characteristics of the products or services concerned and any substantial price differences between the area concerned and neighbouring areas. The territorial scope of the area on the basis of which exposure to competition is assessed shall be limited to the territory of the Member State.
4. For the purposes of paragraph 1, access to a market is deemed not to be restricted if the Member State has implemented and applied the Union legal acts listed in Annex IV. Otherwise, it shall be established that access to the market in question is free in law and in fact.
