Rażąco niskie ofertyZastępuje: dyrektywy 2014/24/EU · dyrektywy 2014/25/EU
1. Nabywcy publiczni wymagają od oferentów wyjaśnienia ceny lub elementów ceny w ofercie, w tym w odniesieniu do jakości oferty, jeżeli wydaje się, że są one rażąco niższe od któregokolwiek z poniższych:
a) cenę lub elementy ceny innej oferty lub ofert otrzymanych w postępowaniu o udzielenie zamówienia;
b) ceny rynkowej, na przykład na podstawie oszacowanej przez nabywcę publicznego wartości zamówienia, w szczególności gdy opiera się ona na konsultacjach rynkowych i obejmuje wszystkie koszty, takie jak koszty pracy i warunków pracy, materiałów i logistyki, oraz koszty spełnienia innych wymogów umownych, a także inne koszty cyklu życia;
c) wartości zamówień w poprzednich postępowaniach o udzielenie zamówienia o zasadniczo identycznym przedmiocie i warunkach, w szczególności w poprzednich szacunkach, ofertach lub cenach płaconych przez tego samego nabywcę publicznego lub innych nabywców publicznych.
Nabywca publiczny może ograniczyć wymóg wyjaśnienia cen lub elementów ceny do oferenta, który złożył najlepszą ofertę zgodnie z art. 98, lub, w stosownych przypadkach, do kilku oferentów, którzy złożyli najlepsze oferty w rankingu.
2. W wyjaśnieniach oferenta stwierdza się, że rentowność ekonomiczna ceny lub elementów ceny zawartych w ofercie nie jest rażąco niska w okresie obowiązywania umowy. Uwzględniają one niski poziom ceny, w tym elementy ceny oraz związek z jakością oferty i przestrzeganiem wszystkich obowiązków, i mogą obejmować w szczególności:
ekonomiki procesu produkcyjnego, świadczonych usług lub metody budowy lub wybranych rozwiązań technicznych;
b) wyjątkowo korzystne warunki, w tym pomoc państwa, jeżeli jest ona zgodna z rynkiem wewnętrznym;
c) czy oferent spełnia wszystkie obowiązki regulacyjne i wymogi strategiczne zgodnie z tytułem II niniejszej części mające zastosowanie do danego zamówienia.
3. Jeżeli nabywca publiczny uzna wyjaśnienia, o których mowa w ust. 2, za zadowalające, odnotowuje swoją ocenę w indywidualnej dokumentacji zgodnie z art. 109.
4. W przypadku gdy wyjaśnienia, o których mowa w ust. 2, nie zostaną uznane za zadowalające, w tym po zwróceniu się o wyjaśnienia lub dodatkowe informacje, nabywca publiczny odrzuca ofertę z postępowania o udzielenie zamówienia.
Article 101
Abnormally low tendersReplaces: Directive 2014/24/EU · Directive 2014/25/EU
1. Public buyers shall require tenderers to explain the price or price elements in the tender, including in relation to the quality of the tender, where these appear to be abnormally below any of the following:
(a) the price or price elements of the other tender or tenders received in the procurement procedure;
(b) the market price such as by the public buyer's estimation of contract value, in particular where it is based on market consultation, and including all costs such as the cost of labour and working conditions, materials and logistics and for complying with other contractual requirements as well as other life-cycle costing;
(c) contract values in past procurement procedures with mostly identical subject-matter and conditions, in particular in past estimations, tenders or prices paid by the same public buyer or other public buyers.
The public buyer may limit the requirement to explain the prices or price elements to the tenderer with the best placed tender in accordance with Article 98, or, where appropriate, to several of the tenderers with the best ranked tenders.
2. The explanations of the tenderer shall establish the economic viability of the price or price elements of the tender as not abnormally low over the duration of the contract. They shall account for the low level of price, including price elements and the relation to the quality of the tender and compliance with all obligations, and may include, in particular, the following:
(a) the economics of the manufacturing process, of the services provided or of the construction method or the technical solutions chosen;
(b) exceptionally favourable conditions, including state aid where such state aid is compatible with the internal market;
(c) whether the tenderer complies with all regulatory obligations and strategic requirements pursuant to Title II of this Part applicable to the contract.
3. Where the public buyer considers the explanations referred to in paragraph 2 to be satisfactory, it shall record its assessment in the individual documentation pursuant to Article 109.
4. Where the explanations referred to in paragraph 2 are not considered satisfactory, including after having asked for clarifications or additional information, the public buyer shall reject the tender from the procurement procedure.
