Ausschlussgründe und Auswahlkriterien

1. Auftraggeber schließen einen Wirtschaftsteilnehmer, einschließlich einzelner Mitglieder einer Gruppe von Wirtschaftsteilnehmern, zu jedem Zeitpunkt des Verfahrens von der Teilnahme an einem Vergabeverfahren aus, wenn dieser Wirtschaftsteilnehmer oder eine Schlüsselperson, die eine juristische Person im Sinne von Unterabsatz 2 betreibt, in einem Mitgliedstaat wegen einer der in diesem Unterabsatz aufgeführten Straftaten oder – in Mitgliedstaaten, die nicht durch den einschlägigen Rechtsakt der Union gebunden sind – wegen einer Straftat, die in gleichwertigen nationalen Rechtsvorschriften festgelegt ist, rechtskräftig verurteilt wurde:
a) Beteiligung an einer kriminellen Vereinigung im Sinne des Artikels 1 Nummer 1 des Rahmenbeschlusses 2008/841/JI des Rates30;
b) Korruptionsdelikte im Sinne der Richtlinie (EU) 2026/102131;
c) Betrug zum Nachteil der finanziellen Interessen der Union im Sinne des Artikels 1 des Übereinkommens über den Schutz der finanziellen Interessen der Europäischen Gemeinschaften und Straftaten im Sinne der Artikel 3, 4 und 5 der Richtlinie
(EU) 2017/137132;
d) terroristische Straftaten und Straftaten im Zusammenhang mit einer terroristischen Vereinigung sowie Straftaten im Zusammenhang mit terroristischen Aktivitäten gemäß den Artikeln 3 bis 12 der Richtlinie (EU) 2017/54133;
e) Geldwäsche im Sinne des Artikels 3 der Richtlinie (EU) 2018/167334;
f) Menschenhandel im Sinne des Artikels 2 der Richtlinie (EU) 2011/3635;
g) Straftaten im Zusammenhang mit der Beschäftigung illegal aufhältiger Drittstaatsangehöriger gemäß den Artikeln 2, 3 und 9 der Richtlinie 2009/52/EG36;
h) Umweltstraftaten im Sinne der Artikel 3 und 4 der Richtlinie
(EU) 2024/120337;
i) Straftaten im Zusammenhang mit dem Verstoß gegen restriktive Maßnahmen der Union gemäß den Artikeln 3 und 4 der Richtlinie (EU) 2024/122638;
j) betrügerische Verwendung unbarer Zahlungsinstrumente im Sinne der Artikel 3 bis 8 der Richtlinie (EU) 2019/71339;
k) Straftaten im Bereich des sexuellen Missbrauchs und der sexuellen Ausbeutung von Kindern gemäß den Artikeln 3 bis 9 der Richtlinie (EU) 2011/9340.
Eine für das Funktionieren einer juristischen Person verantwortliche Person ist eine Person, die eine Führungsposition innerhalb der juristischen Person innehat aufgrund
a) die Befugnis zur Vertretung der juristischen Person;
b) eine Befugnis, Entscheidungen im Namen der juristischen Person zu treffen;
c) eine Kontrollbefugnis innerhalb der juristischen Person.
2. Die in diesem Artikel genannten Ausschlussgründe gelten für einen Zeitraum von fünf Jahren ab dem Tag der Verkündung des rechtskräftigen Urteils, es sei denn, der Ausschlusszeitraum wurde durch das rechtskräftige Urteil festgelegt, was bedeutet, dass nach Ablauf der in diesem Satz genannten Fristen keine Ausschlussentscheidung mehr getroffen werden darf.
3. Auftraggeber schließen einen Wirtschaftsteilnehmer zu jedem Zeitpunkt des Verfahrens von der Teilnahme an einem Vergabeverfahren aus, wenn sie feststellen, dass der Wirtschaftsteilnehmer oder Auftragnehmer seinen Verpflichtungen zur Entrichtung seiner Steuern oder Sozialversicherungsbeiträge nicht nachgekommen ist und dies durch eine rechtskräftige Gerichts- oder Verwaltungsentscheidung festgestellt wurde, es sei denn, der Wirtschaftsteilnehmer hat zu diesem Zeitpunkt eine verbindliche Vereinbarung über die Zahlung der fälligen Steuern oder Sozialversicherungsbeiträge, gegebenenfalls einschließlich etwaiger aufgelaufener Zinsen oder Geldbußen, geschlossen.
Auftraggeber können von dem in Unterabsatz 1 vorgesehenen obligatorischen Ausschluss abweichen, wenn ein Ausschluss eindeutig unverhältnismäßig wäre, insbesondere wenn nur geringfügige Beträge nicht gezahlt werden.
4. Auftraggeber können beschließen, aus zwingenden Gründen des öffentlichen Interesses wie der öffentlichen Gesundheit oder dem Schutz der Umwelt ausnahmsweise von dem in diesem Artikel vorgesehenen obligatorischen Ausschluss abzuweichen. Jede Entscheidung über die Abweichung und die entsprechende Begründung sind daher in den einzelnen Unterlagen gemäß Artikel 109 zu dokumentieren.

Exclusion grounds and selection criteria

1. Public buyers shall at any time during the procedure exclude an economic operator, including individual members of a group of economic operators, from participation in a procurement procedure where that economic operator, or a key person in the functioning of a legal person as defined in the second subparagraph, has been the subject, in any Member State, of a conviction by final judgment for any of the offences listed in this subparagraph, or, regarding Member States not bound by the relevant Union legal act, offences as laid down in equivalent national legislation:
(a) participation in a criminal organisation, as defined in Article 1, point 1, of Council Framework Decision 2008/841/JHA30;
(b) corruption offences, within the meaning of Directive (EU) 2026/102131;
(c) fraud affecting the Union’s financial interests within the meaning of Article 1 of the Convention on the protection of the European Communities’ financial interests and criminal offences referred to in Articles 3, 4 and 5 of Directive
(EU) 2017/137132;
(d) terrorist offences and offences related to a terrorist group, as well as offences related to terrorist activities, as referred to in Articles 3 to 12 of Directive (EU) 2017/54133;
(e) money laundering withing the meaning of Article 3 of Directive (EU) 2018/167334;
(f) trafficking in human beings within the meaning of Article 2 of Directive (EU) 2011/3635;
(g) criminal offences concerning the employment of illegally staying third-country nationals, as referred to in Articles 2, 3 and 9 of Directive 2009/52/EC36;
(h) environmental criminal offences as referred to in Articles 3 and 4 of Directive
(EU) 2024/120337;
(i) criminal offences concerning the violation of Union restrictive measures as referred to in Articles 3 and 4 of Directive (EU) 2024/122638;
(j) fraudulent use of non-cash payment instruments as referred to in Articles 3 to 8 of Directive 2019/713/EU39;
(k) offences in the area of sexual abuse and sexual exploitation of children as referred to in Articles 3 to 9 of Directive (EU) 2011/9340.
A key person in the functioning of a legal person means a personhaving a leading position within the legal person, based on any of the following:
(a) a power of representation of the legal person;
(b) an authority to take decisions on behalf of the legal person;
(c) an authority to exercise control within the legal person.
2. The exclusion grounds set out in this Article shall apply for five years from the date of the delivery of the final judgment, except where the period of exclusion has been set by the final judgment, meaning that no exclusion decision shall be taken after the expiry of the periods referred to in this sentence.
3. Public buyers shall at any time during the procedure exclude an economic operator from participation in a procurement procedure when it becomes aware that the economic operator or contractor is in breach of its obligations relating to the payment of taxes or social security contributions and this has been established by final judicial or administrative decision, except if by that moment in time, the economic operator has concluded a binding arrangement on paying the taxes or social security contributions due, including, where applicable, any interest accrued or fines.
Public buyers may derogate from the mandatory exclusion provided for in subparagraph 1 where an exclusion would be clearly disproportionate, in particular where only minor amounts are unpaid.
4. Public buyers may decide to derogate from the mandatory exclusion provided for in this Article on an exceptional basis, for overriding reasons relating to the public interest such as public health or protection of the environment Any decision to derogate and the justification therefore shall be documented in the individual documentation pursuant to Article 109.
