Diese Verordnung gilt nicht für die Vergabe öffentlicher Aufträge, die ausschließlich Forschungs- und Entwicklungsdienstleistungen im Sinne des Artikels 6 Nummer 16 umfassen.
Satz 1 gilt nicht für die Vergabe öffentlicher Aufträge, die zusätzlich zu Forschungs- und Entwicklungsdienstleistungen im Sinne des Artikels 6 Nummer 16 andere Elemente enthalten, die in den Anwendungsbereich dieser Verordnung fallen, insbesondere wenn Erprobung und Validierung Teil des Innovationsverfahrens gemäß Titel I Kapitel 4 dieses Teils sind oder wenn Forschung und Entwicklung als Innovationstechnik in die Vergabe öffentlicher Aufträge integriert sind, die gemäß Artikel 61 in den Anwendungsbereich dieser Verordnung fallen.

R&D procurement excludedReplaces: Directive 2014/23/EU · Directive 2014/24/EU · Directive 2014/25/EU
This Regulation does not apply to procurement for public contracts exclusively containing research and development services as defined in Article 6, point (16).
The first sentence does not apply to procurement for public contracts containing , in addition to research and development services as defined in Article 6, point (16), other elements falling within the scope of this Regulation, in particular where testing and validation is part of the innovation procedure pursuant to Title I, Chapter 4 of this Part, or where research and development is integrated as an innovation technique in public procurement falling within the scope of this Regulation pursuant to Article 61.
