Zákazky na sociálne, zdravotnícke a vzdelávacie službyNahrádza: , príloha IV smernice 2014/23/EU · smernice 2014/24/EU · smernice 2014/25/EU
1. V prípade verejných zákaziek, ktorých predmetom je niektorá zo služieb uvedených v prílohe VI, môžu obstarávatelia zadávať zákazky v súlade s postupmi stanovenými vo vnútroštátnom práve za predpokladu, že povaha služieb si vyžaduje, aby obstarávatelia zohľadnili osobitosti dotknutých služieb, a za predpokladu, že sa dodržiavajú zásady transparentnosti a rovnakého zaobchádzania, ako aj povinnosti uvedené v odseku 2.
2. Obstarávatelia zadávajúci zákazky podľa odseku 1 tohto článku zohľadnia prostredníctvom vhodných požiadaviek v špecifikáciách, kritériách na vyhodnotenie ponúk alebo podmienkach plnenia zákaziek potrebu zabezpečiť kvalitu, kontinuitu, prístupnosť pre osoby so zdravotným postihnutím, cenovú dostupnosť, dostupnosť a komplexnosť služieb a zapojenie a posilnenie postavenia používateľov vrátane znevýhodnených a zraniteľných osôb s cieľom zabezpečiť ich osobitné osobné zdravotné alebo sociálne potreby. Pri zadávaní takýchto zákaziek obstarávatelia zohľadňujú aj potrebu zabezpečiť dodržiavanie práva osôb so zdravotným postihnutím na sebaurčenie, ako sa stanovuje v článku 19 Dohovoru Organizácie Spojených národov o právach osôb so zdravotným postihnutím.
3. Ak obstarávateľ zadá zákazku podľa tohto článku, uverejní verejné zhrnutie výsledku podľa článku 110 ods. 4 tohto nariadenia najneskôr do 20 dní od zadania zákazky.
Article 58

1. For public contracts having as subject-matter any of the services listed in Annex VI, public buyers may award contracts in accordance with the procedures provided for in national law, provided that the nature of the services makes it necessary for the public buyers to take into account the specificities of the services in question, and that the principles of transparency and equal treatment as well as the obligations in paragraph 2 are respected.
2. Public buyers awarding contracts pursuant to paragraph 1 of this Article shall take into account, through appropriate requirements in specifications, award criteria or conditions for the performance of contracts, the need to ensure the quality, continuity, accessibility for people with disabilities, affordability, availability and comprehensiveness of the services, and the involvement and empowerment of users, including disadvantaged and vulnerable persons, in order to safeguard their specific personal medical or social needs. In awarding such contracts, public buyers shall also take into account the need to ensure respect for the right to self-determination of persons with disabilities, as laid down in Article 19 of the United Nations Convention on the Rights of Persons with Disabilities.
3. Where a public buyer awards a contract pursuant to this Article, it shall publish a public summary of result pursuant to Article 110(4) of this Regulation no later than 20 days after the award.
